IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 8). IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED BELOW. PLEASE READ CAREFULLY.
STRX Technologies, LLC ("STRX", "We", "Us", "Our") provides technology services, hardware sales, and web solutions. By accessing our website, purchasing products, or subscribing to services, you ("User", "Customer") agree to be bound by these Terms of Service ("Terms").
These Terms apply to all STRX Technologies, LLC subsidiaries.

2. Age Restrictions & Eligibility
By using this Service, you represent and warrant that you meet the following age requirements:
Product Orders: Users must be 15 years or older to order products. If under 18, you must have a parent or legal guardian's permission.
Service Appointments: Users must be 15 years or older. If the user is a minor, a parent or legal guardian with a valid photo ID must be present for the duration of any service appointment.
In-Home Visits: In-home service visits are strictly restricted to locations where a person 18 years of age or older with a valid photo ID is present.
General Use: Minors may only use this Website under strict parental or adult supervision.
3. Account Registration & Security
Account Integrity: Accounts may not be registered by bots or automated methods. You agree to provide accurate, current, and complete information during registration.
Confidentiality: You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.
One Account Policy: Each User may register only one account. Accounts are non-transferable and may not be shared.
Termination: You may terminate your account by contacting us. STRX reserves the right to suspend or terminate accounts immediately for violations of these Terms, non-payment, or abusive behavior.
4. Services & Subscriptions
Your use of specific services is governed by these Terms AND the specific agreements linked below:
A. Subscription Agreement
All recurring services (Remote Support, Web Hosting, Managed IT) are subject to the STRX Subscription Agreement. This agreement defines cancellation fees, commitment terms (12-month contracts), and the scope of "Remote Support" (Break/Fix only). By purchasing a subscription, you explicitly agree to the terms found in the Subscription Agreement.
B. Web Development & Hosting
Proprietary Platform: Websites are built on a proprietary Content Management System (CMS). You acknowledge that if you transfer your domain to another provider, your website's design and functionality will not function and cannot be migrated intact.
Non-Payment: Failure to pay hosting fees will result in site suspension (15 days) and permanent data deletion (60 days).
Ownership: Domains registered by STRX remain our property until released. A transfer fee applies for releasing domains to other registrars.
C. Remote Support
Scope: Support is limited to "Break/Fix" issues. We do not provide training (tutoring) or third-party software installation under standard plans.
Fair Use: We reserve the right to limit or terminate support for excessive usage or abuse of staff.
5. Terms of Sale (Products)
A. Return Policy (All Sales Final)
ALL SALES ARE FINAL. We do not accept returns on Custom Computers, Services, or Used Products.
Exceptions: Defective items or items damaged in shipping may be eligible for a claim as outlined in our Return & Refund Policy.
New Products: Subject to manufacturer warranty only.
Used Products: Sold "AS IS" with no warranty.
B. Pricing & Availability
Prices, descriptions, and availability of products are subject to change without notice. We reserve the right to correct pricing errors.
C. Payment Methods
We utilize Stripe and Square for payment processing. We accept major credit cards and financing options including Affirm, Klarna, and Afterpay. STRX Technologies does not store your full financial data; it is handled securely by our processors.
D. Retention of Ownership
Products remain the property of STRX Technologies until full payment is received. If a payment is reversed or charged back, we reserve the right to reclaim the product.
6. Liability, Indemnification & Data
A. Data Loss Waiver
STRX Technologies is NOT responsible for any data loss. Whether during repair, shipping, web hosting, or remote support, it is the User's sole responsibility to back up all data, software, and files. We accept no liability for lost family photos, business documents, or proprietary data.
B. Limitation of Liability
To the maximum extent permitted by applicable law, STRX Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Service Interruption: We may interrupt Service for maintenance or updates. We are not liable for downtime, especially regarding web hosting or cloud services.
C. Indemnification
You agree to indemnify and hold harmless STRX Technologies, LLC and its employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
7. Intellectual Property Rights
Website Content: All content, logos, and software on this Website are owned by STRX Technologies, LLC or its licensors.
Trademarks: "STRX" and "STRX Technologies" are trademarks of STRX Technologies, LLC.
STRX for Creators: Content creators may receive benefits for recommending products. Participation in this program is subject to separate Creator Terms.
8. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
A. Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting hello@strxtech.com. We will try to resolve the dispute within 30 days. If a dispute is not resolved within 30 days, you or STRX Technologies may bring a formal proceeding.
B. Mandatory Binding Arbitration
You and STRX Technologies agree to resolve any claims relating to these Terms, the Services, or Products through final and binding arbitration, except as set forth under "Exceptions to Agreement to Arbitrate" below.
No Judge or Jury: Arbitration procedures are simpler and more limited than rules applicable in court, and review by a court is limited. YOU WAIVE THE RIGHT TO A TRIAL BY JURY.
Arbitration Provider: The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Location: The arbitration shall be held in Brevard County, Florida, or at another mutually agreed location.
C. Class Action Waiver
YOU AND STRX TECHNOLOGIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and STRX Technologies agree, the arbitrator may not consolidate more than one person's claims.
D. Exceptions to Agreement to Arbitrate (Small Claims)
Either you or STRX Technologies may assert claims, if they qualify, in Small Claims Court in Brevard County, Florida, provided the matter remains in such court and advances only on an individual (non-class, non-representative) basis. This preserves your ability to seek redress for smaller disputes without incurring arbitration fees.
E. Governing Law
These Terms shall be governed by the laws of the State of Florida, without respect to its conflict of laws principles.
9. Changes to Terms
STRX Technologies, LLC reserves the right to modify these Terms at any time. We will notify Users of significant changes. Continued use of the Service following such changes constitutes your acceptance of the new Terms.
